In terms of the sound on startup, since its a 2009, its almost certainly the camshaft adjuster sticking (which is of no real concern, other than the horrible noise it makes).

I'll be honest, I can't see what the dealer has done wrong here. They have sold you a car with a comprehensive manufacturer backed 2 year warranty. As far as I can tell there are no faults with the car they have sold you. They are willing to honour the 30 day exchange. It's not really their fault there are no other cars in stock that meet your requirements and budget.

If there was an issue with your car that they were unwilling to resolve, I would understand but as far as I can see that's not the case.

if you reported any fault within 30 days of purchase then you can return it for a full refund - no if's, not but's, no exchanges - Consumer Rights Act 2015.

So long as you reported any fault within those 30 days, the clock stopped ticking. If you reported the diesel like noise on startup, and they did nothing or looked at it and found nothing - then go back with a recording of it. Tell them its the camshaft adjuster sticking, say you want a refund as you reported the fault within 30 days - under those circumstances they are legally obligated to give you a full refund....as for their part ex of your old car they either will have to return the car or give you the money back for it.

Well i have ended up keeping the car as they had no replacement in my price range.
They offered to look at the diesel noise on start up,but i might as well get that looked at under warranty 9 miles for me rather than 210 miles each way to Gloucester.
Not happy but i feel i have no choice.
Going to buy some new spark plugs this week, what was recommended now ?
I may sell it in 12/ 24 months time if something else comes up.

Hopefully the car will give u 24 months of fun, and all the worry was for nothing. Get noise investigated, it's never a bad idea to change sparks and coils if they haven't been changed in the cars history. Hope it goes well and u enjoy ur car
