You can refuse to accept it back, but you should have a good reason for doing so. Damage not repaired completely/properly, mechanical issues, Paint runs, fish eyes in the paint etc.. They may not want to do anything if the only issue is a slight orange peel finish.

Third party insurance accepted liability after a while. My insurance tried to say it looks like a 50/50, the moment I said ill take it to court they called me back in 5 minutes saying other party accept liability lol.
