Something fishy?

Post by coops1221 »

Ok,

Here is the situation; I ordered my roc back in October. I was told it would not be ready until late March early April. I was also told that I would more than likely pay the higher VAT, which, I reluctantly accepted. Today I got the call from my dealer saying that the car would be on build week 6. And that they are expecting delivery late February (which seems a little optimistic) and I was given the option to either pick up the car and pay the 15% tax or wait until March and get it on a 10 plate but would have to pay the extra 2.5% tax.
Now i’m no tax expert but I thought the 2.5% on 1st January?

So.... two questions

1. Do you think they are trying to pull one over on me

2. If needed to make the choice what would you choose?

Just to give you some context the extra % will cost me £550 +, also im not planning on selling the car in the near future

Either way im getting the Roc early so im a happy man :hyper:

VW will cover the increase in VAT if the car is delivered before the end of Feb, simple.

If you're not planning sell for a whie, save the £550, thats probably a couple years insurance saved!

HI, I ordered mine beginning of December knowing that I would have additional VAT to pay, there is a separate charge line on my order form "vat increase 2.5%" listed in Deal options box.
I am also a week 6 build which I understand to be W/C 8th Feb, so end of Feb would be very optimistic..... I have been told to expect mid to end March. Id go for the saving .....£550 towards the mod fund.

IF you'd know you could possibly have done what i did.

I'm getting my car from N.Ireland. It arrived at the dealership at the end of November but i wanted to wait until after 1st Jan to get the car. New plates are issued on 1st Jan in N.I. so i decided to wait and get it registered as 2010.

the dealer (a mate) let me pay for the car just before Christmas at 15% VAT and they wait until this week to register it.

Could you do the same thing with your dealer? Offer to pay now but tell them you want it registered in March? At the end of the day, when it's paid for it's your car and you can do whatever you want with it. Even if you take the car home on a trailer or get hold of some trade plates to drive it home.

ill see if i can give that a go. Going to see my dealer (who i must admit has been a top bloke) and see what if possible i can work out. We are looking to buy a polo for the mrs so will see if that makes the negotiations easier

The WV website says for vehicles ordered between 29th October and 30th November 2009, which I dont understand, as I have been given the same offer when I ordered mine on early October?

My car is confirmed as Build Wk 5, so have already told my dealer I want it registered on or after 1st March 2010, even if it arives prior to that. It may mean a couple of weeks of painful waiting, but I cant see the point of having a new 59 plate for a couple of weeks prior to the 10 plate being out. I have had to wait long enough for it, so want my 6 months of "new reg number" to look forward to :)
I can rely on my car, it's my Roc!!!

So is that registering it on 1st March and paying the 17.5% or the 15%?

Anyway hope you enjoy it when you do get it on the 1st

I've been proper stuffed by my company car lease finance company on this today.

My Roc was ordered back in August/September for delivery on 21/01/10. Whilst I knew about the VAT change coming up, had presumed the quote, order and car itself was all done and dusted months ago considering it had been built and kept in UK storage for the last month or so pending delivery to me on 21/01. Found out today that I have an extra 2.5% VAT to pay (Equating to approx. £720 over next four years) simply as they won't be paying VW for it until delivery on the 21st !! If they'd paid VW for it a week or so ago it would have been on the 15% VAT rate....

Completely useless and inconsiderate bastards springs to mind, like dealing with nothing but a bunch of robots and red tape. :grumpy: Apparently all down to procedure when they pay VW (basically when it's taxed by the dealer prior to delivery) and my quote 'was subject to applicable VAT at the time repayments start' in the small print. Wankers.

as per the statement from vw in the link above in RW1's post you ordered before the 30th Nov therefore you are not liable for the VAT increase, the leasing company won't be paying it to vw (as per this agreement) therefore they can not charge you for it, surely

Well when I read that above I had a glimmer of hope but noted that it applies to orders made after 29th October only (mine was before this) and also applies to private retail customers which I doubt the lease finance company will fall into...

That is actually correct, it will not apply to you - it also depends on how the leasing company bills you. If you get billed with 1 invoice over a period stating that a monthly payment of X will be taken for Y period then you will be taxed at the prevailing rate on the date that invoice is raised. If however you are raised an invoice each month (unlikely but there are one or two that do this) then you will be taxed at the prevailing rate each and every month when the invoice is raised; therefore if the rate increased (which it is likely to do so since we are one of the lowest VAT rates in the EU at the moment - only Cyprus has the statutory lowest limit of 15% - hence why he couldn't lower past 15%) then you will end up paying whatever the rate would change to half way through the agreement.

JMP I still think it would be worth you speaking to VW customer service & asking, I know your contract isn't directly with them but you don't want the leasing company screwing you for an extra 2.5% if they aren't having to pay it to VW.

He can try but you will find that he is irrelevant in the transaction if he is leasing it....it is not financed, therefore the invoice will be raised to the leasing company and the vehicle is owened by them, i.e it is an imput tax on there books, he is subsequently re-invoiced for the car under a leasing agreement - output tax from the leasing company.

It's something like that, bit complicated really but I've looked down all avenues on this and just have to lump it.... I pay the finance instalments under a credit agreement (with a contribution to me from my employer) but the lease company are actually paying VW for it (at 17.5% VAT), on the day the finance starts in January 2010 as yellowplum explained above. Bad timing really but also shit service from the Lease company who never explained any of this until last week...

Anyway, I'm over it now and just looking forward to getting the car after a five month wait. The dealer has confirmed arrival and the correct model/spec so hoping there's no other surprises between now and then. Just want the snow to melt now so I can drive her properly.... you know what I mean. :D
