Well, £450 to remove and refit the gearbox....

Is it worth the gamble? On the off chance they may offer goodwill?

I made sure they agreed to fix the issue with a contribution before they dropped the gear box. They know what it is, countless people have this problem. Have you tried recording the noise and playing it back to them? The dealer I went to presented their mechanic with my footage and he instantly knew what it was without needing to drop the gear box.
Another idea is have you considered purchasing a service plan with them? Or do you need some new tyres? If you need something else like that then you could try reasoning with them and suggesting they help you out with a contribution if you agree to purchase a service plan with them or something?

Took the plunge and booked in for the 9th! Had to agree to costs as they could not diagnose it 100% and I am not prepared to leave it any longer! Better having the issue and reporting after 6 months than having the car a year.

Took them a video and TSB reference, however they cant take my video as evidence....

Service manager said he would ask for some contribution, to which i replied 100%.

I presume it will be the Clutch release bearing leaking and its not down to wear and tear due to my roc only covering 37k.

Not sure whether the original dealer who sold me the car would contribute? I have not bothered contacing them yet because I am expecting them to take the same stance as the one Im booked into.

Will try the service plan one if all goes pear shaped! which it probably will, im expecting it to anyhows

Well an update,
they diagnose a new clutch kit at over £800 + the £450 for removal and refitting.

Apparently the clutch friction and pressure plate are at fault:(

Don't know if Im being screwed over or not however visiting them shortly so they can explain the fault in more detail to me.

Something about some springs, probably on the friction plate.

Anyhows they are saying wear and tear at 37k??

WEIRD!!!! If it is the plates, then it is wear and tear. I am so sorry to hear about this . The thought crossed my mind (during my issue), that if they took off the kit, and the clutch was more worn than usual, they'd blame the plates... I dont know if this was a factor at all.

It's hard to argue unusual clutch wear at 37k, as it depends on the driver.

Seems weird if it's definitely making the exact same noise (hoot) as all the examples I sent you that it's something different. Know any mechanic friends that could come along with you to double check whilst the clutch is all out? I think it's pretty rubbish of them to make you pay the full amount given you've only had it 6 months.

There is a spring in the Dual Mass Flywheel which has a little play to soak up movements which they may be talking about. When i changed my clutch and DMF there was alot of play in the DMF which was not good, glad I bought a new one!

Just thought I would update this thread with the conclusion just incase anyone else falls in the same position i did.

I did end up paying for the clutch kit, around £800 all in. After that I decided to call the original dealer who I purchased the car from as I was considering going down the sale of goods act.

They informed me it is classed as a mechanical failure and that it IS covered under my das welt warranty.

After multiple calls to the repairing dealer and the warranty people I got:-

Not covered, wear and tear etc again, they must give a default NO when the word clutch is mentioned.

I consulted my Das Welt warrenty booklet to find that the pressure plate, bearings and friction material are not covered, howvever my car had been repaired on the basis of the TPI that is availble which states that there is a break down of the springs on the friction plate which causes the sound to be generated throught the pressure plate.

I called them and stressed that in fact the friction plate mechanicals are covered and there is no exclusion in their policy and that my car was reapiared on the strength on the TPI article. They did come back with they do not pay out on 'sounds', only failure but would look at the case. In my eyes the springs had failed, so was prepared to take it further.

I have now to my joy recieved a FULL refund, no apologies though but I would sugguest people do not give up should it happen to them !

Great news Gollfy, I wrote one of the original threads about the same issue I had with my car (call Warranty success because of research) and I got it all done for free because I did my research and never give in to the wear and tear bull s*it. It was due to defect manufacturer parts that eventually they revised (meaning they knew about it)........In my case, the clutch release bearing leaking due to crap design, which caused my clutch hoot /squeel when pulling away.
